These terms apply when you use the Balaana website or the Balaana application. By using either, you agree to them. If you are agreeing on behalf of a business, you confirm you are authorised to do so.

What Balaana is

Balaana is bookkeeping and invoicing software. It records the information you enter and prepares reports from it.

Balaana is not a registered tax agent, BAS agent, accountant or financial adviser. Nothing produced by Balaana is tax, accounting or financial advice. You are responsible for the accuracy of what you enter, for lodging your own returns and statements, and for meeting your obligations to the ATO. Where your affairs need professional advice, get it from a registered agent.

Your account

  • You must give accurate details and keep them current.
  • You are responsible for keeping your login secure and for activity under your account.
  • You must be at least 18 and using Balaana for a lawful business purpose.
  • Tell us promptly if you believe your account has been accessed without your authorisation.

Plans and billing

  • The free plan is provided at no charge and requires no payment details.
  • Paid plans are billed in advance for the period you choose, in Australian dollars, including GST.
  • You may cancel at any time. Cancellation takes effect at the end of the period you have already paid for, and we do not pro-rata refund the remainder of a period.
  • Payments collected through Balaana carry the payment provider's transaction fee, which is passed through at cost and disclosed before you enable payments.
  • If we change our prices, we will give you notice before the change applies to your account, and you may cancel instead.

Your data is yours

You own the information you put into Balaana. We store and process it to provide the service to you, and for no other purpose. We do not sell it or share it with advertisers. You can export your records at any time, on any plan, and deleting your account deletes them.

You are responsible for keeping your own copies of records you are legally required to retain — Australian businesses must generally keep records for five years.

Acceptable use

You must not:

  • Use Balaana to break the law, or to issue false or misleading invoices.
  • Attempt to gain unauthorised access to the service or to other users' data.
  • Interfere with the operation of the service, or resell it as your own.

We may suspend an account that is being used this way, and will tell you why where we lawfully can.

Availability

We work to keep Balaana available and your data safe, but no online service is available without interruption. We may need to take the service down for maintenance, and will give notice where we reasonably can.

Consumer guarantees and liability

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.

Subject to that, and to the extent permitted by law, Balaana is not liable for indirect or consequential loss, and our total liability in connection with the service is limited to the amount you paid us in the twelve months before the claim arose. On the free plan, where you have paid us nothing, that limit is the resupply of the service.

Ending the agreement

You may stop using Balaana and close your account at any time. We may end or suspend your access if you materially breach these terms, or if we stop offering the service — in which case we will give you reasonable notice and a period to export your records.

Changes to these terms

We may update these terms. If a change is material we will tell you before it takes effect, and continuing to use Balaana after that date means you accept the updated terms.
